HISTORY OF THE MEDICAL MARIJUANA ISSUE IN WINDSOR...


Medical Marijuana Moratorium
Over the past several months, the Town Board has discussed the issue of Medical Marijuana as it effects the Town of Windsor.  Initially the Planning Department prepared maps depicting areas within Windsor that are zoned GC (General Commercial), I-L (Limited Industrial) and I-H (Heavy Industrial) to show possible locations for Medical Marijuana facilities.

On December 16, 2009 Ordinance 2009-1363 placed a moratorium on the acceptance of new permits/licenses for Medical Marijuana dispensaries within the Town of Windsor.

On February 8, 2010 that moratorium was extended to June 15, 2010 by Ordinance 2010-1368.

A February 9 Work Session focused on Operational and Licensing considerations for Medical Marijuana facilities.  A memo from the Town Attorney details portions of the discussion draft.

Ballot Question
The Town Board presented the following question to Windsor voters on April 6, 2010.  This question was approved for vote by Resolution 2010-06

"UNLESS AND UNTIL THERE IS A FINAL JUDICIAL DETERMINATION THAT SUCH A PROHIBITION WOULD VIOLATE THE COLORADO CONSTITUTION, SHOULD THE TOWN BOARD FOR THE TOWN OF WINDSOR PASS AN ORDINANCE PROHIBITING THE OPENING OF ANY MORE MEDICAL MARIJUANA DISPENSARIES WITHIN THE TOWN'S CORPORATE LIMITS?"

                                          No - 905


Following the Election
The Town Board held extensive discussions on a draft Ordinance to bring for consideration  The draft was accompanied by a memo from the Town Attorney, noting the similarities and differences compared to House Bill 1284.

Public Hearings were held on July 1 and July 12.

Ordinance 2010-1377 Regulating commercial activity associated with the use, possession distribution and cultivation of Medical Marijuana was passed on July 26.  Ordinance 2010-1380 extended the moratorium already in effect until Ordinance 2010-1377 can take effect.

A Question for the Voters
A citizen initiative will ask voters to decide to accept or reject the following: 
    
     SHALL THE TOWN OF WINDSOR, COLORADO, ADOPT AN ORDINANCE TO PROHIBIT THE OPERATION OF MEDICAL MARIJUANA CENTERS, OPTIONAL PREMISES CULTIVATION FACILITIES, AND MEDICAL MARIJUANA-INFUSED PRODUCT MANUFACTURING FACILITIES WITHIN THE TOWN OF WINDSOR, COLORADO, CORPORATE LIMITS?

Resolution 2010-33 outlines the background for this initiative.
